Legal Options After A diagnosis of Mesothelioma

If your doctor diagnosed you or a loved one with mesothelioma, it is important to follow their recommendations to the letter. It is also advisable to receive legal advice from an experienced lawyer, since you could receive compensation for medical expenses, treatments, pain, suffering and lost wages. If you decide to seek legal help, there are three very important questions that a lawyer will ask you:

  1. Were you or your loved one exposed to asbestos or asbestos?
  2. Where and when did this exposure to asbestos occur?
  3. What damage did the person suffer as a result of exposure to asbestos?

Exposure to asbestos at work If the asbestos exposure occurred at work, you could file a lawsuit against your employer. If you worked in the following industries, it is very likely that you were exposed to asbestos:
  •     Building
  •     Factories / manufacturing
  •     Firefighters
  •     Naval building
  •     Military
  •     Aerospace
  •     farming
  •     Food
  •     Automotive
  •     Railway

Asbestos at home

If you were exposed to asbestos at home, you may be able to claim compensation from the owner, in case the house is rented, or from the previous builder or owner if the house is your own. If the house you live or inhabit was built before 1975, it is likely that asbestos has been used in its construction, possibly as a thermal insulator for pipes and boilers. As we have told you in a previous post, the use of asbestos in the United States has not been banned yet. But also in:
  • Roofing materials, especially in the case of flat roofs, but also some roofs
  • Synthetic tiles for floors
  • Coating materials, such as cement fibers
  • Corrugated panels for heavy duty ("heavy duty")
  • The adhesive that adheres tiles to concrete or wood
  • Some types of paint
  • Some types of linoleum
  • Putty of windows
  • Interior insulation of the attic
  • Duct air conditioning insulation (HVAC insulation in English) usually in the form of corrugated or  flat cardboard
  • Cast

Do not wait too long to take action

In the United States there are time limits to start a legal claim called Expiry Deadlines or Statute of Limitations in English. Each state has different deadlines, and they also depend on the type of demand you wish to file. Once the deadline is reached, it will be very difficult to file the claim and earn compensation.

Mesothelioma Pathology

Mesothelioma can be divided into types of localized and diffuse pathology, but the former is extremely rare. What is Mesothelioma and Causes

Mesothelioma is a tumor derived from mesothelial cells of the pleura, peritoneum, pericardium and tunica albuginea. The mesothelium is a membrane that covers all our cavities inside. Pleural is the most common location (80%), affecting the pleura diffusely. The pleura is the membrane that covers the rib cage and the surface of the lungs. It is a rare tumor. It occurs between the 5th and 7th decade of life due to prior occupational exposure to asbestos or asbestos (a mineral) in youth. The incidence is highest in Australia, Belgium and Britain (with more than 20 cases per million inhabitants). The incidence is higher in men than in women. The mean survival of those affected by malignant mesothelioma is between six and 18 months.
